IMERSIAN PTY LTD is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. IMERSIAN PTY LTD ("we," "us," or "Company") operates the Imersian Platform, providing customers ("you") with access to various features related to 3D model management and augmented reality (AR) visualization.
These include:
Uploading, hosting, and publishing 3D models
Embedding 3D models on websites using the Imersian 3D Viewer
Viewing 3D models in AR formats generated by the platform
Additional features as available according to the prices and service plans listed at Imersian Portal.

Additional features or services may have specific terms, which are incorporated here by reference.By accessing the Platform, you agree to these Terms and confirm you have the authority to enter into this agreement. These Terms also apply to any 3D Creation Services provided by Imersian as separately agreed.

The Platform is provided "as-is" and "as available." We and our suppliers disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Platform availability may not be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so some limitations may not apply to you.

Your rights to use the Platform are subject to the following:
No selling, leasing, or otherwise exploiting the Platform commercially.
No reverse engineering or creation of derivative works.
No use of the Platform to develop competing products.
All copyright and proprietary notices must be maintained.
We reserve the right to modify or suspend the Platform with or without notice and are not liable for any related impacts.

You agree not to use the Platform to:
Upload, display, or distribute any content that violates intellectual property rights or is unlawful, harmful, or otherwise objectionable.
Upload malicious software or transmit unauthorized advertising or spam.
Harvest or collect user information or disrupt other users’ experiences.
Attempt unauthorized access to any part of the Platform.
Violation of these policies may result in the removal of content, account termination, and/or notification to law enforcement.

The Platform may display third-party links. We do not endorse, monitor, or control these third parties and are not responsible for their content. Interactions with third-party sites are subject to their own terms and privacy practices.

We grant you a limited, non-transferable license to use the Platform as provided under these Terms. You retain ownership of the content and files uploaded to the Platform, as well as any 3D models created via our 3D Creation Service.

By using the Platform, you grant us a non-exclusive, royalty-free license to use your 3D & AR models for providing the Platform and related purposes, including marketing and analytics. Imersian retains the right to review and, if necessary, remove any content deemed inappropriate or illegal.

Imersian offers monthly and annual subscriptions, managed through your account or by contacting us at info@imersian.com. Subscription fees are due at the start of each period.

Imersian respects copyright law. For copyright infringement claims, please provide a written notification to our designated Copyright Agent, including:
Signature and identification of the copyrighted work
Contact information and a statement affirming the good faith of the claim.

Confidential information shared with Imersian for the purpose of using the Platform is safeguarded and only shared with third parties as necessary for service delivery, under confidentiality obligations.

We reserve the right to terminate your account and access to the Platform for any violation of these Terms. Upon termination, Imersian may retain content internally for analytical purposes. If you consented to allow Imersian to use your 3D & AR models for marketing, this consent can be withdrawn upon account closure.

The Platform is provided on an “as-is” basis without liability for service interruptions or indirect/consequential damages. In case of server downtime exceeding two hours, we will notify you. Extended downtime (beyond 24 hours) will result in a pro-rated discount for each consecutive day.

Disputes arising from these Terms will first be addressed through good-faith negotiations. If unresolved, disputes will be settled via arbitration in accordance with Australian arbitration rules.

By using the Platform, you consent to electronic communications with Imersian and agree that electronic communications satisfy any legal requirement for written communications.

Your use of the Platform is subject to our Privacy Policy, which outlines our data practices.

These Terms are subject to updates, and any substantial changes will be communicated via email or posted on our site. Continued use of the Platform constitutes acceptance of any changes.
